Louisiana Privacy Law Notice:
This policy complies with Louisiana's Database Security Breach Notification Law (R.S. 51:3071 et seq.), Louisiana's Right to Privacy under the Louisiana Constitution Article I, Section 5, and all other applicable Louisiana privacy statutes. Federal laws including the TCPA, CAN-SPAM Act, and COPPA also apply.
15 Information We Collect
GuardFastrack collects the following categories of information in the course of providing our services:
- Business Information — Business name, address, phone number, services, hours, and operational details necessary to build and configure your systems
- Contact Information — Name, email address, phone number, and communication preferences of authorized business contacts
- Payment Information — Billing address and payment details processed through PCI-compliant payment processors. GuardFastrack does not store full payment card numbers
- Communications — Records of emails, messages, and calls between Client and GuardFastrack for service delivery and support
- Technical Information — IP addresses, browser type, and usage data when visiting guardfastrack.com
- End-User Data — Customer information collected through Client's AI receptionist system and website forms, stored in Client's Go HighLevel sub-account and subject to Client's own privacy obligations
16 How We Use Your Information
GuardFastrack uses collected information solely for legitimate business purposes:
- To deliver, configure, and maintain the services outlined in your service agreement
- To communicate with Client about project status, support requests, and service updates
- To process payments and manage billing records
- To improve service quality, templates, and operational methodologies
- To comply with applicable Louisiana state laws and federal regulations
- To prevent fraud and maintain the security of our systems
- To send relevant service announcements — Client may opt out at any time by contacting [email protected] or clicking unsubscribe in any email
17 Information Sharing
GuardFastrack does not sell, rent, or trade Client personal information. Sharing occurs only in these limited circumstances:
- Service Providers — Trusted vendors essential to service delivery (Go HighLevel, payment processors, AI platforms) under strict confidentiality obligations
- Legal Requirements — When required by Louisiana court order, subpoena, or lawful government request
- Louisiana Law Enforcement — Disclosure to state law enforcement when legally required or to prevent imminent harm
- Business Transfers — In the event of GuardFastrack ownership transfer, with 30 days advance written notice to Clients
- With Express Consent — Any other sharing requires Client's explicit written authorization
18 Data Security
GuardFastrack implements reasonable technical and organizational security measures consistent with industry standards and Louisiana law, including:
- Encrypted data transmission using SSL/TLS protocols for all data in transit
- Access controls limiting system access to authorized GuardFastrack personnel only
- Use of reputable, security-certified third-party platforms for data storage and processing
- Regular review and update of security practices and access permissions
- Password protection and two-factor authentication on all GuardFastrack business accounts
No data transmission or storage system is 100% secure. GuardFastrack cannot guarantee absolute security against all potential threats.
19 Louisiana Data Breach Notification — R.S. 51:3071
Louisiana Database Security Breach Notification Law (R.S. 51:3071 et seq.):
In the event of a security breach involving Louisiana residents' personal information, GuardFastrack will: (1) Notify affected Louisiana residents in the most expedient time possible without unreasonable delay; (2) Notify the Louisiana Attorney General if the breach affects more than 500 Louisiana residents; (3) Include in the notification the nature of the breach, information compromised, steps taken to address it, and contact information for affected individuals.
"Personal information" under Louisiana R.S. 51:3073 includes first name or first initial and last name combined with: Social Security number, driver's license number, account number or credit/debit card number with security code, medical information, or login credentials.
20 Cookies and Tracking
The GuardFastrack website uses cookies and similar technologies to improve user experience and analyze traffic, consistent with Louisiana privacy law and applicable federal standards. Users may control cookie preferences through their browser settings. GuardFastrack does not use cross-site tracking cookies for advertising purposes.
Disabling certain cookies may affect website functionality. We use only cookies necessary for site operation and analytics.
21 Third-Party Services
Our services integrate with the following third-party platforms, each governed by their own privacy policies and terms:
- Go HighLevel — Primary CRM, website, and automation platform (gohighlevel.com)
- Twilio / LC Phone — Telecommunications and SMS services integrated within Go HighLevel
- OpenAI and AI Providers — Language and voice AI models powering the receptionist functionality
- Stripe, PayPal, or Square — PCI-compliant payment processing
- Google — Calendar integration, analytics, and advertising tools where applicable
GuardFastrack is not responsible for the privacy practices of third-party platforms. Louisiana clients are encouraged to review each platform's privacy policy independently.
22 Your Rights Under Louisiana Law
Louisiana residents have privacy rights under the Louisiana Constitution Article I, Section 5. GuardFastrack upholds the following rights:
- Right to Access — Request a copy of personal information GuardFastrack holds about you
- Right to Correction — Request correction of inaccurate or incomplete information
- Right to Deletion — Request deletion of your personal information, subject to legal retention requirements
- Right to Opt-Out — Opt out of marketing communications at any time
- Right to Know — Request information about how your data is used and shared

23 Louisiana Wiretapping and AI Call Disclosure — R.S. 15:1303
Louisiana Electronic Surveillance Law (R.S. 15:1303):
Louisiana is a ONE-PARTY CONSENT state. Recording a telephone call is lawful when at least one party to the conversation consents. GuardFastrack's AI system, as a party to the call, may lawfully record conversations under this standard.
AI Identification Requirement:
All GuardFastrack AI receptionist systems identify themselves as virtual assistants or AI systems at the start of each call. Client must not alter this identification protocol. Falsely representing an AI as a human to induce a transaction may constitute an unfair trade practice under Louisiana R.S. 51:1401.
Out-of-State Callers:
If your business receives calls from customers in states requiring two-party consent (e.g., California, Florida, Maryland), Client is solely responsible for compliance with those states' recording laws. GuardFastrack recommends consulting a Louisiana-licensed attorney for multi-state compliance guidance.
24 Children's Privacy — COPPA Compliance
GuardFastrack services are directed exclusively at business owners and professionals aged 18 and older. GuardFastrack does not knowingly collect personal information from children under the age of 13 in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. 6501 et seq.
If GuardFastrack discovers it has inadvertently collected information from a child under 13, it will delete that information promptly. Parents or guardians who believe their child's information may have been collected should contact [email protected] immediately.
